Answer to a question from a reader

Who can I complain to about my former employer failing to submit the correct UIF documents?

The short answer

You should report this to UIF and ask them to intervene, as you cannot claim your UIF benefits until your employer sends the documents.

The whole question

Dear Athalie

What can I do about getting my employer to submit the correctly completed UI-19 form to UIF so that I can claim UIF after being retrenched? I have followed up with my previous employer for two months but despite this, he has still not sent the correct reference number and the documents you need.

The long answer

Your employer is legally obliged to give you the correctly completed UI-19 form so that you can claim UIF.

As you have had no success getting him to do so, you should report this to UIF and ask them to intervene, as you cannot claim your UIF benefits until your employer sends the documents.

These are the contact numbers for UIF:

  • The call centre number is 0800 843 843.

  • The WhatsApp number for UIF is 082 046 8553 where you can talk to a representative. UIF says you can share your reference number, and ID number but warns that you should not share your password or secret code with anyone.

  • The number UIF gives to "escalate your complaint" is 0800 030 007.

If you need to contact the Department of Labour to lay a complaint against your previous employer, the Pretoria head office telephone number for the Department of Labour is 012 309 4000.

You could also ask an organisation like the Black Sash which gives free paralegal advice to help you. Their contact details are:

Email: help@blacksash.org.za

Helpline: 072 66 33 739.

Wishing you the best,
Athalie
